The website is operated by Tech Zeta Scaffolding (“Tech Zeta,” “we,” “us,” or “our”). By accessing or using this website, you agree to these Terms. If you do not agree, do not use the website.
1. About Tech Zeta Scaffolding
Tech Zeta supplies aluminum scaffolding systems, towers, platforms, frames, guardrails, braces, ladders, outriggers, casters, replacement parts, accessories, and custom components to customers in Canada. Products may be manufactured in the United Arab Emirates and imported into Canada. We serve commercial, industrial, construction, maintenance, wholesale, dealer, and other eligible customers across Canada, subject to product availability, delivery capacity, and written agreement.
2. Website Information
Website content is provided for general information and preliminary product-selection purposes. Although we endeavour to keep information accurate and current: Images may be illustrative; Product colours and finishes may vary; Dimensions and weights may be approximate; Specifications may change; Products may differ from images because of manufacturing updates or customer requirements; and Availability, lead times, and pricing are not guaranteed until confirmed in writing. 3. Requests for Quotes
A website submission, telephone inquiry, email, or request for a quote: Is an invitation for Tech Zeta to provide information; Is not an acceptance of an order; Does not guarantee pricing or availability; and Does not create a binding sales contract. A quotation is valid only for the period stated in the quotation. Unless expressly stated otherwise, quotations may exclude: Applicable taxes; Freight and delivery; Customs or special handling; Installation; Site inspection; Engineering or design services; Permits; Training; and Unloading or assembly. If these Terms conflict with a signed agreement, accepted quotation, purchase order expressly accepted by Tech Zeta, or other written sales terms, the more specific written agreement will govern the applicable transaction.
4. Orders and Acceptance
An order becomes binding only after Tech Zeta issues written acceptance or an authorized representative confirms the order in writing. We may refuse or cancel an order before acceptance because of: Product unavailability; Incorrect pricing or specifications; Credit concerns; Delivery restrictions; Suspected fraud; Legal or regulatory restrictions; or Circumstances beyond our reasonable control. Changes requested after acceptance may affect price, production time, delivery, and return eligibility.
5. Pricing, Taxes and Payment
Unless stated otherwise: Prices are quoted in Canadian dollars; Applicable federal and provincial taxes are additional; Freight, delivery, customs, unloading, and installation are additional; Prices may change before written order acceptance; and Payment terms are those stated in the applicable quotation, invoice, or sales agreement. Late payments may be subject to lawful interest, collection expenses, suspended production, withheld delivery, or cancellation as provided in the applicable sales documents. Ownership and risk of loss will transfer according to the applicable quotation, invoice, shipping terms, or written sales agreement.
6. Product Specifications and Custom Products
Standard dimensions shown on the website are general reference dimensions. Final dimensions, configurations, materials, load ratings, finishes, and accessories must be confirmed in the applicable quotation or technical documentation. For custom-manufactured products: The customer is responsible for reviewing and approving drawings and specifications; Production may begin following written approval; Changes after approval may incur additional fees and delays; Reasonable manufacturing tolerances may apply; and Custom products may be non-cancellable and non-returnable. The customer must provide complete and accurate measurements, intended-use information, site conditions, and technical requirements.
7. Product Compliance and Documentation
Products are designed or supplied for applicable Canadian requirements only where expressly stated in the applicable quotation, product documentation, test report, or certification. No website statement should be interpreted as confirming that every product: Is certified to every Canadian standard; Is suitable for every province, territory, project, or application; Has a particular load rating; or Has been approved by a specific authority. Any reference to CSA compliance, certification, testing, engineering, or load rating applies only to the particular product and configuration identified in its current supporting documentation. Customers must request and review applicable technical documentation before ordering or using a product. Tech Zeta may update products or documentation as requirements change.
8. Safe Selection, Assembly and Use
Scaffolding can present serious risks if it is improperly selected, assembled, altered, inspected, maintained, or used. The purchaser, owner, employer, contractor, installer, and user are responsible for: Determining whether a product is suitable for the intended application; Following applicable laws, standards, codes, and workplace-safety requirements; Obtaining required permits and engineering review; Ensuring assembly and use by trained and competent persons; Following all instructions, labels, load limits, and technical documentation; Conducting required inspections; Using appropriate fall protection and access controls; Maintaining safe foundations, levelling, bracing, stabilization, and clearances; Considering wind, weather, electrical, ground, and site conditions; Using only compatible and authorized components; and Removing damaged, modified, or unsuitable components from service. Do not rely solely on website images or descriptions when assembling or using scaffolding.
9. Installation and Engineering Services
Unless expressly included in a written quotation, Tech Zeta does not provide: Installation or dismantling; Site supervision; Structural engineering; Project-specific load calculations; Regulatory approval; Permit services; or Certification of customer-designed configurations. Any engineering or installation service expressly purchased will be governed by separate written terms and the defined scope of work.
10. Shipping and Delivery
Production and delivery dates are estimates unless expressly guaranteed in writing. Delivery may be affected by: Manufacturing schedules; Material availability; Carrier capacity; Customs clearance; Weather; Labour disruption; government action; or Other events beyond our reasonable control. The customer is responsible for providing accurate delivery information, suitable site access, and safe unloading arrangements. Visible shipping damage or shortages should be recorded on the carrier’s delivery documentation and reported promptly in accordance with the applicable quotation or shipping instructions.
11. Returns, Cancellations and Replacement Parts
Returns and cancellations require prior written authorization from Tech Zeta. Unless required by law or otherwise stated in writing: Custom products are non-returnable; Used, installed, altered, damaged, or incomplete products may not be returned; Returns may be subject to inspection, restocking fees, and freight charges; The customer is responsible for confirming part compatibility; and Unauthorized returns may be refused. Return, cancellation, warranty, and replacement-part conditions stated in an accepted quotation or invoice will govern the transaction. Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded.
12. Product Warranties
Any product warranty is limited to the warranty expressly stated in the applicable quotation, invoice, product documentation, or written warranty issued by Tech Zeta. To the maximum extent permitted by law, Tech Zeta disclaims implied warranties or conditions not expressly provided in writing, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. This disclaimer does not exclude warranties or legal rights that cannot be excluded under applicable Canadian law. Warranty coverage may be denied for damage caused by: Incorrect assembly or installation; Misuse, overloading, impact, or abuse; Unauthorized modification or repair; Use with incompatible components; Improper storage or transportation; Corrosion, chemicals, fire, or extreme conditions; Failure to inspect or maintain the product; Ordinary wear and tear; or Failure to follow instructions or applicable requirements.
13. Intellectual Property
All website content—including text, product descriptions, photographs, graphics, catalogue materials, designs, logos, layout, and downloadable documents—is owned by or licensed to Tech Zeta and is protected by applicable intellectual-property laws. You may view or download website content for legitimate internal product-evaluation or purchasing purposes. 18. Indemnification
To the extent permitted by law, you agree to indemnify and hold Tech Zeta harmless from claims, losses, damages, and reasonable expenses arising from: Your unlawful or unauthorized website use; Information or materials you submit; Your violation of these Terms; Your infringement of third-party rights; or Your misuse, unauthorized alteration, or improper combination of products. This section does not apply to the extent a claim was caused by Tech Zeta’s own conduct for which liability cannot lawfully be excluded.
19. Force Majeure
Tech Zeta will not be responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, epidemic, labour disruption, transportation interruption, supplier failure, material shortages, customs delays, government restrictions, utility failure, or cyber incidents.
20. Governing Law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights, disputes relating to the website will be submitted to the courts located in Toronto, Ontario.
21. Consumer Rights
Some customers may have mandatory rights under federal or provincial law that cannot be waived or limited by contract. 22. Changes to These Terms
